Terms and conditions

The terms for using the site and buying on it — in clear language and in accordance with Israeli law.

This page is a translation of the Hebrew original. If the two differ, the Hebrew version prevails.

Welcome to the hemma website (the “Site”), operated by Comfortly Ergonomics Ltd, company no. 516790979 (the “Company”). Use of the Site and making a purchase on it are subject to the terms below. These terms are written in the masculine form for convenience only and refer to all genders.

1. General

  1. Browsing the Site and/or placing an order constitutes agreement to these terms, the privacy policy, the shipping policy and the cancellation policy.
  2. The Company may update these terms from time to time. The binding version is the one published on the Site when the order is placed.
  3. Anyone aged 18 or over may buy on the Site, provided they hold a valid credit card issued in Israel or another payment method the Site accepts, and have a delivery address in Israel.

2. Disclosure — parallel import

  1. The Company is a parallel importer and is not the official importer of Herman Miller in Israel. The Company is not affiliated with, authorized or certified by Herman Miller, Inc., MillerKnoll or the official importer.
  2. The products sold on the Site are original, brand-new products in their original packaging, purchased from authorized suppliers outside Israel.
  3. The product warranty is provided by the Company alone, for 3 years, as detailed in the warranty certificate. The manufacturer or the official importer are not obliged to provide service or a warranty for products bought on the Site.
  4. Herman Miller®, Aeron®, PostureFit SL®, 8Z Pellicle® and Harmonic™ are registered trademarks of their owners. The names, images and videos are used on the Site only to describe the original product being sold.

3. The product, price and stock

  1. Prices on the Site are in new Israeli shekels and include VAT as required by law. The price does not include additional costs unless stated otherwise; delivery within Israel is free of charge.
  2. Product images are for illustration. Some images on the Site show the Aeron family in colors and configurations other than the one being sold; the configuration being sold is the one detailed on the product page and in the technical specifications.
  3. Slight differences in color between the image and the actual product may occur because of screen settings. If a typing error or an obvious pricing error occurs, the Company may cancel the transaction, notifying the customer and fully refunding any amount paid.
  4. Orders are subject to stock availability. If the product runs out after an order is placed, the Company will notify the customer and offer an alternative delivery date or cancellation with a full refund.

4. Placing an order and payment

  1. Orders are placed through the checkout page on the Site. Completing an order is subject to approval by the credit card company.
  2. Credit card payment is processed by the payment processor Tranzila over an encrypted connection. Credit card details are not stored by the Company.
  3. You may pay in up to 12 interest-free installments, subject to approval by the credit card company.
  4. Immediately after payment is approved, a tax invoice/receipt is sent by email to the address you provided, as required by law. The chair's serial number is recorded by us at the time of shipment for warranty purposes.

5. Delivery, cancellation and warranty

Delivery terms are detailed in the shipping policy; cancellation terms in the cancellations and returns policy; and warranty terms in the warranty certificate. These documents are an integral part of these terms.

6. Intellectual property

All content on the Site — including design, texts, code and the Company's trademarks — belongs to the Company or to third parties who permitted its use. It may not be copied, distributed or used commercially without prior written permission. YouTube videos embedded on the Site belong to their owners and are displayed using YouTube's embedding tools.

7. Company liability

  1. The Company works to keep the information on the Site accurate and up to date, but inaccuracies or omissions beyond its control may occur.
  2. Information on the Site about ergonomics and back health is general only and is not medical advice. In case of back pain or a medical problem, consult a professional.
  3. The Company will not be liable for indirect or consequential damage, subject to any applicable law.

8. Prohibited use

You may not use the Site unlawfully, place false orders, try to break into the Site's systems or run automated tools to collect information.

9. Governing law and jurisdiction

These terms are governed by the laws of the State of Israel only. The competent courts in the Tel Aviv-Jaffa district have exclusive jurisdiction.
